2. Scope

These Terms and Conditions govern access to, browsing and use of the VEICOMER online shop, as well as orders placed through it.

By using this website or placing an order, the Customer declares that they have read, understood and accepted these Terms and Conditions.

3. Customers

The VEICOMER online shop is intended for end consumers and for professional/business customers.

For the purposes of these Terms:

  • A “Consumer” is a natural person acting for purposes outside their commercial, industrial, craft or professional activity.
  • A “Professional customer” or “business” is any natural or legal person acting within the scope of their commercial or professional activity.

Some rules, namely those relating to the right of withdrawal and the legal consumer guarantees, apply to consumers only.

4. Account registration

Creating a customer account is mandatory to purchase from the VEICOMER online shop.

The Customer is responsible for ensuring that the data provided is correct, complete and up to date. VEICOMER is not responsible for delays, delivery errors, incorrect documents or inability to make contact resulting from incorrect or incomplete data provided by the Customer.

5. Products

VEICOMER sells parts for car and motorcycle engines.

The images, photographs, technical descriptions, references, measurements, compatibilities and other information shown on the website are provided as accurately as possible; however, there may be minor differences from the final product, especially when these result from changes made by manufacturers or suppliers.

Product photographs are for illustration purposes only, unless expressly stated otherwise.

6. Parts compatibility

It is the Customer’s responsibility to confirm in advance that the part is compatible with the vehicle, engine, model or application for which it is intended.

Where applicable, the Customer should confirm the manufacturer’s reference, OEM reference, VIN number, model, year, engine or any other relevant technical information.

VEICOMER may provide technical support whenever possible, but cannot be held responsible for incompatibilities resulting from incorrect, incomplete or insufficient information provided by the Customer.

7. OEM references and equivalents

OEM references, brands, models or equivalent references shown on the website are intended solely for the technical identification and compatibility of the products.

The use of these references does not imply that the products are original parts from the vehicle manufacturer, unless expressly stated.

8. Prices

Prices shown in the online shop are in euros, unless otherwise stated.

Prices may or may not include VAT, depending on how they are shown on the website and the applicable tax rules.

VEICOMER reserves the right to change prices at any time without prior notice. Changes do not affect orders that have already been confirmed, except in the case of an obvious error.

9. Pricing or information errors

In the event of an obvious error in the price, description, stock, technical characteristics or commercial terms of a product, VEICOMER reserves the right to cancel the order, informing the Customer and refunding any amounts paid, where applicable.

An obvious error is one that is evident, disproportionate or clearly incompatible with the normal market value of the product.

10. Orders

Orders are placed through the online shop by selecting the products, creating or signing in to a customer account, choosing the payment method and giving final confirmation.

After submitting the order, the Customer will receive an automatic confirmation by email.

The automatic order confirmation does not in itself constitute final acceptance of the order, which remains subject to payment validation, product availability and confirmation by VEICOMER.

11. Stock availability

The availability shown on the website is based on the information available at the time.

Despite VEICOMER’s efforts to keep this information up to date, stock shortages, synchronisation errors, changes by suppliers or temporary unavailability may occur.

If an ordered product is not available, VEICOMER may offer the Customer the option to:

  • wait for restocking;
  • replace it with an equivalent product;
  • cancel all or part of the order;
  • receive a refund of the amount paid for the unavailable product.

12. Made-to-order products

Some products may be marked as “Por Encomenda”, “Sob Encomenda”, “Fabricado por Encomenda” (made to order) or an equivalent expression.

These products are not available for immediate dispatch and are manufactured, prepared or ordered from the manufacturer/supplier specifically after the Customer’s order.

The estimated dispatch time for these products is generally 4 to 6 weeks, unless stated otherwise on the product page or in later communication from VEICOMER. This time frame is only an estimate and may vary for reasons beyond VEICOMER’s control, including production delays, international transport, customs, temporary unavailability of raw materials or changes by the manufacturer.

13. Cancellation of made-to-order products

The Customer may request the cancellation of a made-to-order product as long as it has not yet been ordered from the manufacturer or supplier.

Once VEICOMER has started the process with the manufacturer or supplier, or once manufacturing/preparation has begun, cancellation is no longer possible, unless expressly agreed by VEICOMER.

This rule applies in particular to products manufactured or sourced specifically for the Customer.

14. Returns of made-to-order products

Made-to-order products may only be returned in the event of a defect, lack of conformity or error attributable to VEICOMER.

Returns of made-to-order products are not accepted when due to a change of mind, wrong choice, incompatibility resulting from incorrect data provided by the Customer, or a change in purchase intention.

15. Payment methods

The VEICOMER online shop may offer the following payment methods:

  • Credit card;
  • PayPal;
  • Multibanco;
  • MB WAY.

The availability of each payment method may vary depending on the country, order value, technical configuration or payment provider.

Orders will only be processed after payment has been confirmed, unless expressly stated otherwise.

16. Payment security

Payments are processed by specialised third-party providers.

VEICOMER does not store full bank card details.

The Customer should also consult the terms and privacy policies of the payment providers used, namely PayPal and the entities responsible for processing card, Multibanco or MB WAY payments.

17. Invoicing

VEICOMER issues invoices using certified software.

Invoices are not issued automatically at the time of purchase and may be issued later, after internal validation of the order and of the Customer’s tax details.

The Customer is responsible for providing correct billing details when placing the order.

18. Shipping

VEICOMER ships to Portugal and abroad.

Shipments may be made by carriers such as TNT, UPS or other logistics providers selected by VEICOMER.

For products in stock, the normal estimated dispatch time is 2 to 5 working days, unless stated otherwise.

Delivery times are estimates and may vary depending on the destination, carrier, customs, stock shortages, periods of high logistics volume or other external factors.

19. International shipping, customs and local taxes

VEICOMER sells worldwide, except where logistical, legal or operational impossibility arises.

All customs charges, import duties, local VAT, customs fees or any other taxes charged by the authorities of the destination country are the sole responsibility of the Customer.

VEICOMER is not responsible for delays caused by customs procedures, inspections, holds or documentation requirements of the authorities of the destination country.

20. Receiving the order

On delivery, the Customer must check the outer condition of the packaging.

If there are visible signs of damage, tampering, moisture, crushing or any anomaly, the Customer must refuse the delivery or accept it with a written reservation to the carrier.

The Customer should report any transport damage to VEICOMER as soon as possible, sending photographs of the packaging and the product.

21. Right of withdrawal

In distance contracts, the consumer may exercise the right of withdrawal within the legal period of 14 days, except for the exceptions provided for by law.

This right applies to consumers only and does not apply to professional customers or businesses when the purchase is made within the scope of their commercial or professional activity.

The 14-day period generally starts on the day the consumer, or a third party indicated by them, takes physical possession of the goods.

22. Exclusions from the right of withdrawal

The right of withdrawal may not apply, namely, to:

  • goods made to the consumer’s specifications;
  • personalised goods;
  • made-to-order products manufactured specifically for the Customer;
  • goods which, by their nature, cannot be returned or are liable to deteriorate;
  • products that have been used, installed, fitted, damaged or are incomplete for reasons attributable to the Customer;
  • sealed products that are not suitable for return for health protection or hygiene reasons if unsealed after delivery.

23. Return conditions

For a return to be accepted, the product must be:

  • free of signs of use, fitting or installation;
  • complete;
  • in its original packaging, where applicable;
  • accompanied by the accessories, manuals, labels and documents received;
  • in a resaleable condition, except in cases of defect or lack of conformity.

VEICOMER reserves the right to refuse returns that do not meet these conditions.

24. Return costs

In the event of an error attributable to VEICOMER or a defective/non-conforming product, the return costs will be borne by VEICOMER.

In the event of withdrawal by the Customer, where legally permitted, the return costs will be borne by the Customer.

25. Refunds

After receiving and inspecting the returned product, VEICOMER will refund the amounts due using the same payment method used for the purchase, unless otherwise agreed.

VEICOMER may withhold the refund until it has received the returned goods or until the Customer has provided proof of having sent them back.

26. Legal guarantee

Products sold to consumers benefit from the legal guarantee of conformity provided for in the applicable legislation.

In the event of a lack of conformity, the consumer should contact VEICOMER by email at geral@veicomer.com, describing the problem and attaching photographs, videos or any other useful information.

The guarantee does not cover damage resulting from:

  • incorrect fitting;
  • improper use;
  • normal wear and tear;
  • inadequate maintenance;
  • alterations or repairs carried out by third parties;
  • use in competition, abnormal stress or conditions not foreseen by the manufacturer;
  • incompatibility resulting from incorrect data provided by the Customer.

27. Guarantees on business sales

For sales to professional customers or businesses, the legal and commercial conditions specific to B2B relationships apply, as well as the guarantees provided by the manufacturers or suppliers.

Where applicable, VEICOMER may act as an intermediary in the guarantee process with the manufacturer or supplier.

28. Installation and fitting

VEICOMER is not responsible for damage arising from incorrect installation, fitting, adjustment or use of the products.

We recommend that technical parts are installed by a qualified professional.

29. Customer responsibilities

The Customer undertakes to:

  • provide correct data;
  • check compatibility before purchasing;
  • use the products in accordance with the manufacturer’s instructions;
  • not use the website for unlawful purposes;
  • respect the rights of VEICOMER and of third parties.

30. Limitation of liability

VEICOMER will not be liable for delays, non-performance or damage resulting from events not attributable to it, including carrier delays, stock shortages, manufacturer delays, strikes, conflicts, natural disasters, technical failures, customs restrictions, legislative changes or other cases of force majeure.

31. Intellectual property

36. Applicable law and jurisdiction

These Terms and Conditions are governed by Portuguese law.

In the event of a dispute, and without prejudice to the mandatory legal rules applicable to consumers, the court with jurisdiction under Portuguese law shall be competent.

37. Changes to the Terms and Conditions

VEICOMER reserves the right to change these Terms and Conditions at any time.

Changes will be published on the website and apply only to orders placed after their publication.
